ARTICLE 2 – SUBJECT OF THE AGREEMENT
This Agreement defines the rights and obligations of the parties regarding the accommodation service purchased by the BUYER through the website www.rosegardenhotel.com.tr.
This Agreement has been prepared in accordance with Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.
By approving this Agreement, the BUYER is deemed to have accepted the website’s terms of use and privacy policy.

ARTICLE 4 – DEFINITIONS
Hotel: Rose Garden Premium
Seller: Pusula Otelcilik Turizm Sanayi ve Ticaret A.Ş.
Buyer: Natural or legal person making a reservation via the website
Best Flexible Rate: Rate allowing free cancellation or modification within a specified period
Non-Refundable Rate: Prepaid and non-refundable rate
Packages and Offers: Promotional rates including additional services
ARTICLE 5 – EFFECTIVENESS
This Agreement enters into force upon completion of the reservation and receipt of payment.
In case of force majeure (natural disasters, war, epidemics, governmental decisions, etc.), the parties shall not be liable. Payments made will be refunded within 30 days.
ARTICLE 6 – RESERVATION AND CANCELLATION CONDITIONS
6.1 Non-Refundable Rate
No refund will be made in case of cancellation, modification, or no-show.
6.2 Flexible Rate / Packages / Offers

Free cancellation up to 15 days (360 hours) before check-in

Cancellations less than 15 days before check-in: 30% of total stay charged

Cancellations less than 7 days before check-in: 100% of total stay charged
(No-show: 100% charge)
ARTICLE 7 – PAYMENT PROCEDURE
The reservation becomes final after payment is received via virtual POS by credit card.
If the bank cancels the transaction, the Seller shall have no obligation to provide the service.
ARTICLE 8 – RIGHT OF WITHDRAWAL
The BUYER may exercise the right of withdrawal within 14 days from the payment date.
However, pursuant to Article 15/g of the Regulation on Distance Contracts, the right of withdrawal does not apply to accommodation services provided on a specific date.
If less than 15 days remain before check-in, the right of withdrawal cannot be exercised.
Refunds are made only to the credit card. No cash refunds are made.
ARTICLE 9 – PERSONAL DATA PROTECTION
The BUYER’s personal data shall be processed in accordance with Law No. 6698 for the purposes of:

Fulfillment of legal obligations
The BUYER declares having read the Information Notice and consents to data processing.
ARTICLE 10 – COMPETENT COURT
In case of dispute:

For consumer BUYERS: Consumer Arbitration Committees and Consumer Courts

For non-consumer BUYERS: Courts and Enforcement Offices of Antalya
